To answer the question you received: The new City Centre regulations will only be applied when the owner of the property makes an application to the City to rezone the property, usually to redevelop to a higher density or to accommodate new uses in a new building.

If a property owner wishes to rezone and keep the existing building the businesses and structures will be “grandfathered” under the previous regulations as long as they operate and remain unchanged for a period of 6 months or more. If the use is discontinued for a period longer than 6 months it must abide by the new regulations. Also any alterations to the building must not cause further non-conformity to the new regulations.

The rules and regulations around non-conforming uses and “grandfathered” uses can be found in the Local Government Act, Division 14 and by accessing this link. It is much easier to address on a case by case basis.

I’ve attached the Bylaw but please note it is been to first reading only so it is not yet adopted and, at this stage, is still subject to amendments determined by Council.

Please let me know if you receive any other questions/correspondence and thank you again for your assistance in this!

Regards,
Lauren

Hi Lauren,

Thanks for sending this through to me – I think you will have seen that I sent it out to those Langford businesses in our database on Monday.

I’ve had one query that has come through to me so far. Is the intent of the zoning to be applied to new developments and/or applications for rezoning only? In other words, if there is a current ground floor business in an existing building whose owner wishes to expand beyond the 70 square meters described for the CCP zone, will that owner be able to do so? The comment I’ve had is that 70 square meters is not a huge space and there are already some ground floor businesses in the zone that exceed this.

Is there an online link to the whole zoning package?

Thanks Lauren!
