Dear Sir/Madam:
Subject
National Holdings Ltd. v. Patricia Cuthbert also known as Marva Patricia Cuthbert and others; Supreme Court of British Columbia Victoria Registry No. VIC-S-H-248630
2486 Jeanine Drive, Langford, BC ("Property") – Request for extension of time to comply with Remedial Action Order (Section 76(3) of the Community Charter)
I am the solicitor for National Holdings Ltd., holder of the first mortgage on title to the Property. My client has commenced foreclosure proceedings and was granted an order for conduct of sale on October 14, 2025, which gives my client the exclusive right to list and market the Property on the Multiple Listing Service. The Property is currently listed and actively marketed by a licensed Realtor.
Several parties have expressed interest in submitting an offer on the Property but are hesitant to do so given the uncertainty of the costs involved for the City to demolish the unpermitted structure as set out in the Remedial Action Order dated November 3, 2025. As the associated costs will be added to the Property tax roll, prospective buyers are concerned about incurring the liability for these costs upon completion of the sale of the Property. In particular, one buyer is in a position to submit an unconditional offer on the Property and is committed to taking all steps required by the Remedial Action Order, provided that they are given a reasonable time to do so.
I am writing to request that Council approve a one-month extension to comply with the Remedial Action Order, to March 2, 2026, pending an accepted offer to purchase the Property and court approval of that offer. Once the court approves a sale, I expect that the purchaser will commit to immediately remediate the Property as required by the Remedial Action Order.
Please let me know if any further information is required to consider this request.
Thank you.
Yours very truly,
Aron P. Hochhauser
