Aquatic Centre Management Reserve Fund Establishment Bylaw
Staff Report to Council
DATE: Monday, July 20, 2026
DEPARTMENT: Administration
SUBJECT: Aquatic Centre Management Reserve Fund Establishment Bylaw
Executive Summary
At the June 29, 2026, Special Council Meeting, Council directed staff to bring forward the necessary bylaw to establish the City’s Aquatic Centre Management Reserve Fund. The proposed reserve fund will receive and hold funds contributed pursuant to the Aquatic Centre Supplementary Agreement with the YMCA/YWCA. This report brings forward the proposed reserve fund establishment bylaw for Council’s consideration.
Background
On June 29, 2026, Council considered a staff report regarding the Langford Aquatic Centre Supplementary Agreement with the YMCA. The purpose of the Supplementary Agreement was to ensure that any surplus generated through operation of the Aquatic Centre remains connected to the facility and continues to support Langford Aquatic Centre operations, programming, and related facility needs.
At that meeting, Council resolved:
THAT Council direct staff to bring forward all necessary bylaws and related documents to establish the City’s Aquatic Centre Management Reserve Fund for the purpose of receiving and holding funds contributed pursuant to the Supplementary Agreement and using those funds solely for Aquatic Centre related expenses.
The Supplementary Agreement provides that, if the Langford Aquatic Centre generates a profit, a portion of that profit is to be paid to the City and deposited into the City’s Aquatic Centre reserve fund once established. Specifically, the agreement outlines that 50% of the first $100,000 of profit, and 75% of the remaining profit, will be paid to the City and deposited into the reserve fund.
Commentary
The proposed bylaw is intended to create a dedicated reserve fund for monies received by the City under the Supplementary Agreement.
Establishing the reserve fund by bylaw will ensure that funds received from the YMCA are held separately and used only for Langford Aquatic Centre related costs. Under the proposed bylaw, funds in the reserve may be used for costs related to the repair, maintenance, renewal, upgrade, improvement, or replacement of the facility and its equipment, fixtures, building systems, and infrastructure.
Financial Implications
If funds become payable to the City pursuant to the Supplementary Agreement, those funds will be deposited into the reserve fund and used solely for the expenses set out in the attached bylaw. This structure supports the City’s objective of ensuring that financial benefits generated from the Langford Aquatic Centre remain connected to the facility with a direct benefit to the community.
Legal Implications
Section 188 of the Community Charter authorizes Council to establish a reserve fund for a specified purpose and direct that money be placed to the credit of that reserve fund. Section 189 of the Community Charter provides that money in a reserve fund, and interest earned on it, must only be used for the purpose for which the fund was established. The proposed bylaw establishes the Aquatic Centre Management Reserve Fund for the specified purpose of receiving and holding funds contributed pursuant to the Supplementary Agreement and using those funds solely for the Langford Aquatic Centre-related expenses set out in the attached bylaw.
Strategic Plan Alignment
- 5b – Ensure all budgets are fiscally sustainable and transparent.
