3. PUBLIC HEARING

a) BYLAW NO. 1599

"Langford Zoning Bylaw, Amendment No. 441, (Text Amendment — New RR7 [Rural Residential 7 - Klahanie] Zone), 2015".

b) BYLAW NO. 1601

"Langford Zoning Bylaw, Amendment No. 442, (881 Klahanie Dr), 2015".

The Mayor opened the Public Hearing for Bylaw No. 1599 and 1601 at 7:04 p.m.

Mayor Young advised members of the audience that any person present who believes that his or her interest is affected by the proposed bylaws shall be given an opportunity to be heard on the matters contained in the proposed bylaw. Those who wish to speak concerning this proposed bylaw should give their name, address and views concerning the proposed bylaw. Mayor Young advised that after everyone has expressed their views, he shall state three times "Is there anyone else who wishes to be heard", and if no further views are forthcoming, the Public Hearing shall be declared closed.

The City Planner advised that William and Beverley Wilson have applied to amend the zoning of 881 Klahanie Dr from the RR2 (Rural Residential 2) Zone and that the purpose of the Public Hearing was to hear from the public regarding Bylaw No.1599 and 1601 which, if adopted, would amend the zoning of 881 Klahanie Dr from the RR2 (Rural Residential 2) Zone to the new RR7 (Rural Residential 7) Zone.

This is being proposed in order to allow for the development of approximately 11 residential lots. As part of this application, a public hearing is required in accordance with the regulations of the Local Government Act.

The applicant has provided a possible lot layout reflecting the minimum lot size of 800m2 Council established for the RR7 Zone at the time of 1st Reading. The applicant has demonstrated that Council's target of 30% greenspace can be accomplished with this layout, and the proposed greenspace will be secured by covenant as a condition of bylaw adoption. The greenspace proposed for preservation has not been selected to preserve any sensitive ecosystems on the subject property, but to provide a greater degree of spatial and aesthetic separation in the development. As such, portions of the greenspace have been previously disturbed, including the area of the greenspace which overlaps with an easement in the northeastern corner of the subject property.

The Approving Officer has noted that, in order to subdivide the subject property, the applicant is to address the area of the subject property that is within the easement granted to the neighbouring property. If this entails transferring portions of the subject property to the adjacent property at 775 Latoria, the covenanted protection of the greenspace secured though the present rezoning would be transferred with the land. Addressing the easement lands to the Approving Officer's satisfaction may require a reorganization of the lot layout and may affect lot yield.

In support of this application, the applicant has agreed to provide the following as a bonus for increased density, the following contributions per new lot created, prior to subdivision approval:

  • $6,000 towards the General Amenity Reserve Fund;
  • $1,000 towards the Affordable Housing Reserve Fund;
  • A Section 219 covenant, registered prior to bylaw adoption, in priority of all other charges on title, that agrees to the following:
    • That advisory notes be written to provide future owners with the understanding that the South Vancouver Island Rangers gun range is located just over a kilometer away and may generate a noise nuisance;
    • That the owner shall submit to the City a tree retention and replanting plan prior to Development Permit issuance;
    • That, prior to Building Permit issuance, the owner shall register a Section 219 Covenant on title for all new lots created, to protect as non-disturbance area those portions of the lots identified as green space on the site plan attached, to the satisfaction of the Director of Planning;
    • That the owner shall carry out the replanting works specified in the replanting plan within 12 months of Building Permit issuance, to the satisfaction of the Director of Planning; and
    • That full frontage improvements shall be provided by the owner prior to subdivision approval, to the satisfaction of the Director of Engineering; AND
  • A Section 219 covenant, registered prior to subdivision approval, on the title of any new lots created which are affected by the easement and building encroachment, advising future owners of the implications of the easement and encroachment, to the satisfaction of the Director of Planning.

"Langford Zoning Bylaw, Amendment No. 443, (2781 Strathmore Rd), 2015".

The Mayor opened the Public Hearing for Bylaw No. 1605 at 7:16 p.m.

Mayor Young advised that after everyone has expressed their views, he shall state three times "Is there anyone else who wishes to be heard", and if no further views are forthcoming, the Public Hearing shall be declared closed.

The City Planner advised that Gary Brown of Paradise Homes Ltd. has applied to amend the zoning of 2781 Strathmore Road and that the purpose of the Public Hearing was to hear from the public regarding Bylaw No. 1605 which, if adopted, would amend the zoning of 2781 Strathmore Road from the R2 (One and Two-Family Residential) Zone to the MU1A (Mixed-Use Residential Commercial A) Zone.

This is being proposed in order to allow for the development of approximately 10 residential dwelling units in a three storey condominium building.
