Subject
Bylaw No. 1619 - Application to Rezone a portion of 2793 Leigh Rd from BT1 (Business and Technology Park) to CS3 (Commercial Industrial)
Background
The City of Langford has been in discussions with the owner of 1096/1098 Goldstream Ave to obtain a portion of their property as road for the purposes of improving the intersection of Goldstream Ave and Leigh Rd. Council considered and supported a land swap proposal that would involve transferring a —345 m2 portion of the City's adjoining property at 2793 Leigh Rd and a —47 m2 portion of the Leigh Rd right-of-way that is not necessary for the road improvements to the owner in exchange for the land required for the intersection improvements.
Commentary
The City's property at 2793 Leigh Rd is currently zoned BT1 (Business and Technology Park); whereas 1096/1098 Goldstream Ave is zoned CS3 (Commercial Industrial). While the Zones are quite similar in nature, it is more practical for the owner of 1096/1098 Goldstream Ave that the —345 m2 of land to be transferred be subject to the same Zoning as the existing property. As such, Bylaw No. 1619 has been drafted for the purpose of rezoning the —345 m2 portion of the City's property to the CS3 Zone. This is consistent with the Official Community Plan Designation of Mixed Use Employment Centre.
Legal Implications
The road closure and lot consolidation processes will be managed separately at a later date, and will follow the necessary legal procedures. It is noted that road rights-of-way do not hold a zoning designation, and that once an area of road is closed, it takes on the zoning of the adjoining property.
Options
That Council:
- Give first reading to Bylaw No. 1619;
- Take no action at this time with respect to Bylaw No. 1619.
